These Terms and Conditions (“Terms”) govern your use of mobile applications provided by Kitaka James Newton (“we,” “us,” or “our”). They apply to Yum Check and to other scanner, vision, and utility applications that link to these Terms (the “Apps”).
By downloading, installing, or using an App, you agree to these Terms. If you do not agree, do not use the App.
1. The Apps
The Apps may use a device camera, photo library, artificial intelligence, or other technologies to analyze images or other content and provide informational results. Features vary by App and may change over time.
Some features may require internet access, device permissions, or a paid subscription.
2. Eligibility
You may use an App only if you can form a binding agreement in your jurisdiction. If you are under the age of majority where you live, you may use an App only with the consent and supervision of a parent or legal guardian.
3. License and Acceptable Use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Apps for lawful, non-commercial purposes, subject to these Terms and the applicable app-store rules.
You must not:
- copy, modify, distribute, sell, lease, or sublicense an App except where law permits it;
- reverse engineer, decompile, or attempt to extract source code except where law permits it;
- bypass usage limits, payment controls, security measures, or access restrictions;
- use an App to violate the law or the rights of another person; or
- submit content you do not have the right to use, including unlawful, harmful, or infringing content.
You remain responsible for the content you choose to scan or submit.
4. AI-Generated Results and Important Disclaimers
Apps may generate results automatically using artificial intelligence. These results can be inaccurate, incomplete, outdated, or unsuitable for your circumstances. Always use independent judgment and verify important information.
The Apps provide general informational assistance only. They do not provide medical, dietary, nutritional, legal, financial, safety, professional, or emergency advice. In particular, food or ingredient analyses are not a diagnosis and should not be used to determine whether a product is safe for you to eat or whether it meets your dietary, allergy, or medical needs. Read the product label and consult a qualified professional when appropriate.
5. Purchases and Subscriptions
An App may offer free features, trial offers, one-time purchases, or automatically renewing subscriptions. Prices, billing periods, and included features are shown in the App or App Store before purchase.
Purchases are processed by Apple through the App Store. Your purchase is subject to Apple’s terms and policies. Unless otherwise stated at purchase, subscriptions renew automatically until cancelled. You can manage or cancel a subscription through your Apple App Store account settings. Deleting an App does not cancel a subscription.
We do not control Apple’s billing process and do not store your payment-card information. Refund requests are handled according to Apple’s policies.
6. Third-Party Services
Apps may rely on independent providers, including AI, cloud, analytics, and subscription services. Your use of those services may be subject to their separate terms and privacy policies. We are not responsible for third-party services or their availability.
7. Intellectual Property
The Apps, including their software, design, text, graphics, trademarks, and functionality, are owned by us or our licensors and protected by applicable intellectual-property laws. These Terms do not give you ownership of an App or its content.
Third-party names, products, images, and trademarks may appear in scan results for identification purposes. Their use does not imply affiliation with, endorsement by, or sponsorship of the relevant rights holder.
8. Availability and Changes
We may modify, update, suspend, or discontinue any App or feature at any time. We do not guarantee that an App will always be available, uninterrupted, secure, or error-free. You may need to install updates to continue using an App.
9. Disclaimer of Warranties
To the maximum extent permitted by law, the Apps are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity, arising from or related to your use of or inability to use an App.
To the maximum extent permitted by law, our total liability for all claims relating to an App will not exceed the amount you paid us for that App during the 12 months before the event giving rise to the claim, or US$10 if you paid nothing.
Nothing in these Terms excludes liability that cannot legally be excluded.
11. Termination
You may stop using an App at any time by uninstalling it. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Apps, users, or others.
12. Governing Law
These Terms are governed by the laws of Uganda, without regard to conflict-of-law rules. Where applicable law gives you mandatory consumer protections, those protections remain in effect.
13. Changes to These Terms
We may revise these Terms from time to time. The revised Terms will be posted on this page with an updated “Last updated” date. Your continued use of an App after the revised Terms take effect constitutes acceptance of them.
